Terms of Service — Orlando Smart Concierge

These Terms govern your use of Orlando Smart Concierge (the “App”), published by Daniel Mori. By installing or using the App, you agree to these Terms. If you do not agree, do not install or use the App.
1. Who We Are
Orlando Smart Concierge is an independent mobile application for travelers visiting the Orlando, Florida area. The App is not affiliated with, endorsed by, or sponsored by Walt Disney World, Disney Parks, Universal Orlando, Universal Studios, NBCUniversal, SeaWorld Parks & Entertainment, LEGOLAND, Merlin Entertainments, Busch Gardens, or any other theme park operator. References to those parks are nominative and used solely to describe the App’s functionality.
2. What the App Does
The App offers:
- Park Butler — an AI assistant for theme-park questions (wait times, ride recommendations, currency, shopping)
- Tax & Price Hunter — a price-tag scanner that calculates final cost in your currency including sales tax
- SafeStop — a curated map of higher-risk shopping/parking areas and a parking tracker
- Lightning Lane Assistant — translates and explains screenshots from theme-park apps
- Trip Pass — a 15-day paid pass that unlocks the AI features
3. Trip Pass — The Paid Subscription
3.1 What you get
Trip Pass grants 15 days of access to the App’s AI features (Park Butler and Lightning Lane Assistant) from the moment of purchase. Other features (Tax & Price Hunter, SafeStop map, parking tracker) remain free.
3.2 Price
US$ 24.99 (United States base price). Apple converts and adjusts prices automatically in other regions.
3.3 Non-renewing — no auto-charge
Trip Pass is a non-renewing subscription. After 15 days the access expires automatically and you will not be charged again unless you explicitly purchase another Trip Pass.
3.4 How payment works
You pay Apple through the App Store. Your payment is processed by Apple under Apple’s terms. We never see your credit card information. The transaction appears on your Apple ID billing statement.
3.5 Refunds
All refunds are handled by Apple under Apple’s standard refund policy. To request a refund, visit reportaproblem.apple.com and select your Trip Pass purchase. We have no ability to issue refunds directly.
3.6 Restoring purchases
If you reinstall the App or use it on another iPhone/iPad signed into the same Apple ID, the “Restore purchase” button on the Trip Pass screen will reactivate your existing entitlement.
4. Acceptable Use
You agree to use the App only for its intended purpose. You will not:
- Use the App for any illegal purpose
- Attempt to bypass App Attest, RevenueCat entitlement checks, or rate limits
- Use Park Butler as a general-purpose chatbot — the assistant is scoped to Orlando travel topics and will refuse other requests
- Reverse-engineer, decompile, or attempt to extract source code or our API keys
- Use the App to harvest data from theme-park APIs at scale, scrape pricing, or build a competing product
- Submit content (images, chat messages) that is illegal, hateful, harassing, sexually explicit, or otherwise objectionable
We reserve the right to revoke access to the App’s backend (block your anonymous device key or IP) for violations.
5. Accuracy of Information — Important Disclaimers
5.1 Wait times
Wait times are sourced from the public themeparks.wiki community API. They are typically refreshed every 10 minutes, but real-world queue lengths can change minute-to-minute. Treat wait times as informational, not authoritative.
5.2 SafeStop zones
SafeStop zones are based on editorial curation of publicly reported incident patterns at Orlando-area tourist destinations. They are not a real-time police feed and are not a substitute for personal judgment, common sense, or local law-enforcement guidance. We do not guarantee that any zone marked “low risk” is safe, or that any zone marked “high risk” will have incidents.
5.3 AI responses
Park Butler and Lightning Lane Assistant use a third-party large language model (Google Gemini). AI responses can be wrong, outdated, or misinterpret your question. Always verify critical information (return windows, prices, opening hours, age restrictions, height restrictions) with the official park’s own app or staff.
5.4 Currency conversions
Exchange rates come from ExchangeRate-API and are refreshed periodically. Actual rates charged by your credit-card issuer will differ. Sales tax and IOF are calculated using the rates in effect as of the App’s release; consult your bank or accountant for authoritative numbers.
5.5 No professional advice
Nothing in the App is medical, legal, financial, or safety advice. The App is for informational and entertainment purposes only.
6. Intellectual Property
The App, its design, source code, logo, and original content are owned by Daniel Mori. Third-party trademarks (Disney, Universal, SeaWorld, etc.) belong to their respective owners and appear only in nominative reference to those companies’ parks and services.
You retain ownership of content you create (such as parking notes or chat messages). By sending chat messages to Park Butler, you grant us a limited license to transmit those messages to Google Gemini for the purpose of generating a reply.
7. Service Availability
We provide the App “as is” and may modify, suspend, or discontinue any part of the App at any time without notice. We do not guarantee uninterrupted service. If a major service is removed during your active Trip Pass period, contact us for resolution.
8. Termination
You may stop using the App at any time by uninstalling it. We may terminate your access (block your device key) if you breach these Terms. Termination does not entitle you to a refund of the Trip Pass.
9. Limitation of Liability
To the maximum extent permitted by law, the App is provided “as is” and “as available”, without warranties of any kind, express or implied. Daniel Mori is not liable for:
- Inaccurate wait times, prices, or safety information
- Any loss, theft, injury, or damage occurring during your trip
- Decisions you make based on the App’s recommendations
- Loss of data, downtime, or interruptions in service
- Charges by your mobile carrier related to data usage
In no event will our total liability exceed the amount you paid for Trip Pass in the 12 months preceding the claim.
Some jurisdictions do not allow certain limitations of liability. Where applicable law prohibits these limitations, our liability is limited to the maximum extent permitted.
10. Indemnification
You agree to indemnify and hold harmless Daniel Mori from any claim arising out of (a) your misuse of the App, (b) your violation of these Terms, or (c) content you submit to the App.
11. Governing Law and Jurisdiction
These Terms are governed by the laws of the Federative Republic of Brazil, without regard to its conflict-of-law principles. The publisher of the App, Daniel Mori, is an individual resident in Brazil.
Consumers in Brazil
If you are a consumer in Brazil under the Código de Defesa do Consumidor (Federal Law 8.078/1990), nothing in these Terms limits the rights guaranteed to you by that law. You may bring any consumer dispute in the courts of your own domicile (Art. 101, I, CDC), and the consumer-protection rules of the CDC apply regardless of any contrary clause in these Terms.
Consumers outside Brazil
If you are a consumer resident in the European Union, the United Kingdom, the United States (state-law consumer protections, including but not limited to California’s CCPA/CPRA), or any other jurisdiction, this provision does not deprive you of the mandatory consumer-protection rules of your home jurisdiction. You may also bring a claim under the consumer-protection law of your residence where local law requires it.
Non-consumer disputes
For disputes that are not consumer disputes, the parties elect the courts of the City of São Paulo, State of São Paulo, Brazil, as the exclusive forum, expressly waiving any other.
Apple’s role
Apple is the merchant of record for Trip Pass purchases under Apple’s own terms. Disputes about the charge itself (refunds, billing errors) are governed by Apple’s policies and handled through Apple’s support channels, not by these Terms.
12. Changes to These Terms
We may update these Terms from time to time. Material changes will be reflected by updating the “Last updated” date. Continued use of the App after a change indicates acceptance of the updated Terms.
